1. Agreement and eligibility
These Terms are an agreement between you and Cavexo LLC, 6809 Mentone St, Coral Gables, FL 33146, United States. By downloading, installing, or using Dalia, you agree to these Terms and the App Privacy Policy. If you disagree, do not use Dalia.
You must be at least 16 years old to use Dalia. If you have not reached the age of majority where you live, you may use it only with authorization from your parent or legal guardian when required by applicable law. If you use Dalia for an organization, you represent that you are authorized to do so.
The app distributed through the App Store is also subject to Apple's standard End User License Agreement. These Terms supplement it; mandatory Apple terms or applicable law control where required.
2. What Dalia provides
Dalia helps you record and understand meals, activity, and daily context. It may include:
- records of meals, glucose, insulin, activity, sleep, notes, and profile information;
- authorized reading from Apple Health;
- food analysis using photos, text, or barcodes;
- artificial intelligence summaries and explanations;
- optional Open Food Facts searches and contributions;
- optional accounts to recover identity and Dalia Pro access;
- free and subscription features.
We may modify, improve, limit, or discontinue features. We will try to provide reasonable notice when a material change affects a primary paid feature.
3. Not medical care
Dalia is an educational and personal organization tool. It is not a medical device, does not diagnose or prescribe treatment, and is not a substitute for a healthcare professional.
Results, nutrition estimates, alerts, and AI content may be incomplete or incorrect. Do not make decisions about medication, insulin, treatment, or emergencies based only on Dalia. For symptoms, immediate risk, or an emergency, contact emergency services and a qualified professional.
4. Account and identity
Dalia may create a technical identity and allow you to link it using Apple, Google, or a passwordless link sent to your email address. You are responsible for:
- securing access to your device and identity provider;
- providing legitimate information and not impersonating another person;
- notifying us if you suspect unauthorized access.
The account may recover identity and Pro access on a compatible device. It is not a backup and does not guarantee synchronization of records stored locally.
We may restrict or suspend an account for fraud, abuse, security risk, breach of these Terms, or legal requirements.
5. Local data and deletion
Your personal records are stored mainly on your device. You are responsible for keeping any copy you need before deleting data, uninstalling the app, changing devices, or resetting a device.
Deleting local data and deleting the account are separate actions. Account deletion does not recover or automatically delete content stored only on another device, cancel an Apple subscription, or remove an Open Food Facts contribution already published.
Data processing is described in the App Privacy Policy.
6. Subscriptions and payments
Dalia Pro may be offered as an in-app purchase or subscription:
- Apple processes charges, refunds, taxes, renewal, and cancellation under its terms;
- price and billing period are displayed before confirmation;
- subscriptions renew automatically unless cancelled within Apple's stated timeframe;
- you can manage or cancel through your App Store account;
- deleting Dalia or your account does not cancel a subscription.
Access may take time to update or require “Restore Purchases.” If these Terms conflict with Apple's purchase screen, Apple's mandatory purchase terms control.
7. Artificial intelligence
AI features generate probabilistic estimates and text. By using them:
- you confirm that you have the right to submit the photos, text, and other content;
- you acknowledge that the result may contain errors and must be reviewed;
- you must not submit unnecessary personal information or unlawful content;
- you must not use the result as the sole basis for a medical decision.
We do not guarantee that two analyses will produce the same result or that every food, portion, or context will be recognized correctly.
8. Open Food Facts and your content
You may choose to send product information to Open Food Facts. Before confirming a contribution, verify that:
- the information and photos match the product;
- you took the images or have the right to share them;
- people, addresses, receipts, or other personal information are not visible;
- the content does not violate rights or laws.
By confirming submission, you authorize Cavexo to transmit the content and grant the licenses needed to publish and reuse it under Open Food Facts' terms and licenses. A public contribution may remain available after you close your Dalia account.
You retain any rights you hold in the content. You are responsible for what you submit.
9. Permitted use
We grant you a personal, limited, revocable, non-exclusive, non-transferable license to use Dalia on devices authorized by Apple.
You may not:
- compromise security, bypass limits, or interfere with the service;
- scrape data, automate requests, or reverse engineer except where permitted by law;
- use Dalia to violate rights, harass, deceive, or distribute unlawful content;
- resell, sublicense, or present Dalia as your own service;
- attempt to manipulate subscriptions, accounts, contributions, or results.
10. Third-party services and content
Dalia depends on authentication, payment, infrastructure, artificial intelligence, and food database services. Their terms, availability, and decisions may affect features. Cavexo does not control the accuracy of external databases or continued operation of third-party services.
Third-party trademarks, databases, and content belong to their respective owners.
11. Intellectual property
Dalia, its software, design, brand, and original content belong to Cavexo or its licensors. These Terms do not transfer ownership to you. We may use feedback or suggestions you send to improve the product without compensation, without affecting ownership of your data or content.
12. Availability, suspension, and termination
The app may experience interruptions, errors, or changes. We do not promise uninterrupted availability or permanent compatibility with every device or iOS version.
You may stop using Dalia at any time. We may suspend access for the reasons in section 4. Provisions that by their nature should continue—including intellectual property, liability, and dispute terms—survive termination.
13. Warranties and liability
To the fullest extent permitted by law, Dalia is provided “as is” and “as available.” Cavexo does not warrant that results are accurate, complete, fit for a particular purpose, or error-free.
To the fullest extent permitted by law, Cavexo is not liable for indirect, incidental, special, consequential damages, or loss of data arising from Dalia. Our total liability for a claim related to the app will not exceed the amount you paid for Dalia in the prior 12 months or USD 100, whichever is greater.
These limitations do not exclude liability that cannot legally be limited or reduce mandatory consumer rights.
14. Governing law and disputes
These Terms are governed by the laws of the State of Florida, United States, without limiting mandatory consumer protections in your place of residence.
Before filing a claim, email dalia@cavexo.com and we will try to resolve it in good faith. For users in the United States, and only where legally enforceable, disputes will be resolved individually through binding arbitration; arbitration is not required where applicable law prohibits it or for matters eligible for small claims court.
15. Changes and contact
We may update these Terms to reflect product, provider, or legal changes. We will publish the current date and version and give reasonable notice of material changes. Continued use after the effective date constitutes acceptance where permitted by law.
